WildCare (“WildCare,” “we,” “us,” or “our”) is a nonprofit California public benefit corporation dedicated to wildlife rehabilitation, education, and conservation. We respect your privacy and are committed to protecting the personal information entrusted to us by donors, volunteers, program participants, employees, supporters, and website visitors. This Privacy Policy explains what information we collect, how we use and share it, your rights regarding your information, and your choices.
By using our website, making a donation, volunteering, participating in our programs, or otherwise interacting with WildCare, you agree to the terms of this Privacy Policy.
1. Scope and Application
a. Website and Services. This Privacy Policy applies to personal information collected through WildCare’s website at
www.discoverwildcare.org (the “Site”), our Wildlife Hotline, our Wildlife Help Assistant chatbot, email and text communications, donor portals, in-person interactions, and all other services and programs offered by WildCare (collectively, the “Services”).

We will post the updated Privacy Policy on this page with a revised effective date. Your continued use of the Services after any changes constitutes your acceptance of the updated Privacy Policy. We encourage you to review this Privacy Policy periodically.
2. Information We Collect
WildCare collects personal information in several ways depending on how you interact with us. “Personal information” means information that identifies, relates to, describes, or is capable of being associated with a particular individual.
a. Information You Provide Directly. We collect personal information that you voluntarily provide to us when you:
(1) Make a monetary donation or pledge through our website, by mail, by telephone, or in person;
(2) Report injured, orphaned, sick, or distressed wildlife through our Wildlife Hotline, online wildlife assistance request forms, or in-person contacts;
(3) Contact our Wildlife Hotline or submit online requests for wildlife assistance, guidance, or information;
(4) Register for an educational program, class, workshop, tour, event, or fundraising activity;
(5) Apply to become a volunteer or complete volunteer registration, training, or orientation materials;
(6) Sign up to receive email newsletters, text message updates, or other communications from WildCare;
(7) Contact us through our website contact forms, email, telephone, or postal mail with questions, comments, feedback, or requests;
(8) Create or access a secure donor account or donor portal through our third-party service providers;
(9) Interact with WildCare’s website chatbot (the “Wildlife Help Assistant”);
(10) Apply for employment or submit employment applications or resumes;
(11) Participate in surveys, contests, or promotional activities; or
(12) Provide information in connection with your attendance at WildCare’s facility or participation in on-site activities.
b. Categories of Personal Information Collected. Depending on the nature of your interaction with WildCare, the personal information we collect may include:
(1) Identifiers, such as your real name, alias, postal address, email address, telephone number, mobile phone number, social media handle, online identifier, Internet Protocol (IP) address, or other unique identifiers;
(2) Customer Records Information, such as name, signature, address, telephone number, credit card number, debit card number, bank account information, or other financial information;
(3) Donation Information, such as donation amount, donation date, designation or restriction preferences, recurring gift elections, payment method, transaction history, and donor recognition preferences;
(4) Wildlife Assistance Information, such as descriptions of wildlife in distress, location information, photographs or videos of wildlife, your relationship to the wildlife situation, and any follow-up communications;
(5) Volunteer and Program Participation Information, such as volunteer application materials, availability, skills, interests, emergency contact information, program registration details, attendance records, and participation history;
(6) Employment Application Information, such as resume, cover letter, references, work history, education, and other information provided in connection with an application for employment;
(7) Communications Content, such as the content of emails, hotline calls, chatbot conversations, form submissions, surveys, and other communications you send to us or exchange with us;
(8) Protected Classification Characteristics, such as age or date of birth, if voluntarily provided;
(9) Internet or Other Electronic Network Activity Information, such as browsing history on our Site, search history, information regarding your interaction with our Site or advertisements, pages viewed, links clicked, and other usage data; and
(10) Geolocation Data, such as general geographic location derived from your IP address or precise location information if you provide it in connection with wildlife assistance requests.
c. Information Collected Automatically. When you visit our Site or use our Services, we may automatically collect certain technical information through cookies, web beacons, analytics tools, and similar technologies, including:
(1) Device Information, such as your device type, operating system, browser type and version, screen resolution, and device identifiers;
(2) Usage Information, such as pages visited, time spent on pages, links clicked, referring and exit pages, date and time of visits, and clickstream data;
(3) IP Address and Location Data, such as your IP address and general geographic location inferred from your IP address; and
(4) Cookie and Tracking Data, as described in Section 8 below.
d. Information from Third Parties. We may receive personal information about you from third parties, including:
(1) Payment Processors and Donation Platforms, who provide us with donation transaction information, payment confirmation, and related data;
(2) Data Cooperatives and Modeling Services, as described in Section 5 below;
(3) Publicly Available Sources, such as public records, social media platforms, and publicly accessible websites;
(4) Wildlife Agencies and Rehabilitation Partners, who may share information with us in connection with wildlife rescue, rehabilitation, or transport activities;
(5) References and Emergency Contacts, provided by volunteers or employees; and
(6) Affiliated Organizations and Partners, who may share information in connection with joint programs, events, or fundraising activities.
e. Sensitive Personal Information. WildCare does not intentionally collect “sensitive personal information” as defined under California law, such as Social Security numbers, driver’s license numbers, financial account login credentials, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, or health information, except in limited circumstances where necessary for employment purposes or with your express consent. If you provide payment card information to make a donation, that information is processed securely by our third-party payment processors and is not stored by WildCare.
3. How We Use Your Information
WildCare uses the personal information we collect for the following purposes:
a. Charitable Mission and Program Delivery. To carry out WildCare’s charitable mission, including:
(1) Providing wildlife assistance, rescue, rehabilitation, intake coordination, and related services;
(2) Administering educational programs, classes, workshops, tours, events, and public outreach activities;
(3) Managing and coordinating volunteer activities, training, and engagement; and
(4) Conducting wildlife conservation, research, and advocacy activities.
b. Donation Processing and Stewardship. To process, acknowledge, and steward charitable contributions, including:
(1) Processing one-time and recurring donations;
(2) Providing donation receipts and acknowledgment letters for tax purposes;
(3) Managing donor accounts, donation history, and recurring gift preferences;
(4) Responding to donor inquiries and requests; and
(5) Recognizing donors in accordance with their preferences and applicable legal requirements.
c. Communications and Engagement. To communicate with you and keep you informed about WildCare’s work, including:
(1) Responding to your inquiries, requests for information, and requests for wildlife assistance;
(2) Sending updates, newsletters, and announcements about WildCare’s programs, events, wildlife stories, and organizational news;
(3) Providing information about fundraising campaigns, giving opportunities, and ways to support WildCare;
(4) Sending event invitations, reminders, and follow-up communications;
(5) Conducting surveys and soliciting feedback to improve our programs and services; and
(6) Fulfilling any other purpose for which you provided the information.
d. Website and Service Improvement. To operate, maintain, analyze, and improve our Site and Services, including:
(1) Enhancing website functionality, navigation, and user experience;
(2) Improving the performance and accuracy of our Wildlife Help Assistant chatbot;
(3) Analyzing website traffic, usage patterns, and visitor behavior;
(4) Troubleshooting technical issues and debugging errors; and
(5) Developing new features, programs, and services.
e. Organizational Operations and Compliance. To carry out internal business operations and comply with legal obligations, including:
(1) Maintaining organizational records, donor databases, and program participation records;
(2) Complying with federal and state tax reporting requirements, charitable solicitation registration requirements, and other legal obligations;
(3) Conducting internal audits, data analysis, and research;
(4) Processing employment applications and managing employee and volunteer records;
(5) Enforcing our terms of use, policies, and legal agreements; and
(6) Protecting the rights, safety, property, and security of WildCare, our staff, volunteers, program participants, donors, and the public.
f. Fraud Prevention and Security. To detect, prevent, and respond to fraud, unauthorized access, security incidents, and other illegal activities.
g. Legal Obligations. To comply with applicable laws, regulations, legal processes, and governmental requests.
4. Legal Bases for Processing (California and General)
WildCare processes personal information on the following legal bases:
a. Consent. Where you have provided your consent to the processing of your personal information for a specific purpose, such as signing up for email or text communications or agreeing to participate in a survey.
b. Contractual Necessity. Where processing is necessary to fulfill our obligations to you, such as processing your donation, providing wildlife assistance services you requested, or administering programs or events for which you registered.
c. Legitimate Interests. Where processing is necessary for WildCare’s legitimate interests in carrying out its charitable mission, fundraising activities, donor stewardship, program delivery, organizational operations, and communications, provided that such interests are not overridden by your privacy rights.
d. Legal Obligations. Where processing is necessary to comply with federal or state law, including tax reporting, charitable solicitation registration, employment law, and other legal requirements.
5. How We Share Your Information
WildCare does not sell personal information for commercial purposes. We do not sell the personal information of minors under 16 years of age. We may share your personal information with third parties in the following circumstances:
a. Service Providers. We share personal information with trusted third-party service providers who assist us in carrying out our mission and operations. These service providers are contractually obligated to use your personal information only for the purposes we specify and to protect the confidentiality and security of your information. Service providers include:
(1) Donation Processing and Payment Platforms, such as online donation platforms, payment processors, and merchant services providers;
(2) Donor Database and Customer Relationship Management (CRM) Providers, who host and maintain our donor and constituent databases;
(3) Email and Text Communication Platforms, such as email service providers, text messaging services, and marketing automation platforms;
(4) Website Hosting Providers, who host and maintain our website and related infrastructure;
(5) Analytics Providers, who provide website analytics, visitor tracking, and performance monitoring services;
(6) Chatbot and Artificial Intelligence Providers, who provide and support our Wildlife Help Assistant chatbot;
(7) Fundraising and Development Consultants, who assist with fundraising strategy, donor research, campaign planning, and grant writing;
(8) Technology and IT Support Providers, who provide technical support, cybersecurity services, and IT infrastructure management; and
(9) Professional Advisors, such as attorneys, accountants, auditors, and insurance providers.
b. Wildlife Assistance and Rehabilitation Partners. We may share wildlife assistance information and related personal information with:
(1) Licensed veterinarians who provide medical care for wildlife in our care;
(2) State and federal wildlife agencies, including the California Department of Fish and Wildlife, U.S. Fish and Wildlife Service, and National Marine Fisheries Service, as required by law or to coordinate wildlife rescue and rehabilitation activities;
(3) Other licensed wildlife rehabilitation organizations and facilities to coordinate care, transfer, or release of wildlife;
(4) Volunteer transport drivers and wildlife rescue volunteers who assist with wildlife rescue, transport, and release activities; and
(5) Other individuals or organizations when necessary to provide wildlife assistance services or protect wildlife welfare.
c. Nonprofit Data Cooperatives and Audience Modeling Programs. WildCare participates in nonprofit data cooperatives and audience modeling programs operated by third-party service providers. These programs help nonprofit organizations identify individuals who may be interested in supporting charitable causes similar to WildCare’s mission. Participation in these programs involves:
(1) Information Shared. We may share limited supporter information with cooperative service providers, including name, mailing address, email address, telephone number, general engagement information (such as donation recency, frequency, and general range), and demographic or interest information. We do not share credit card numbers, bank account information, or precise donation amounts.
(2) Data Use and Modeling. Information shared through these programs may be aggregated, anonymized, or de-identified and combined with information from other participating nonprofit organizations to develop predictive models, audience segments, and prospecting lists. These models help nonprofits better understand donor behavior and identify prospective supporters.
(3) Anonymization. When information is shared through cooperative modeling programs, WildCare is not identified as the source organization. Recipients of modeled data or prospecting lists do not receive information indicating that you have a prior relationship with WildCare.
(4) Opt-Out Right. You have the right to request that your information be excluded from nonprofit data cooperative and audience modeling programs. To exercise this right, contact us using the contact information in Section 12 below.
d. Affiliated Organizations and Partners. We may share personal information with affiliated nonprofit organizations, fiscal sponsors, partner organizations, and collaborators in connection with joint programs, co-sponsored events, collaborative fundraising efforts, or shared mission activities.
e. Legal Requirements and Protection of Rights. We may disclose personal information when we believe disclosure is necessary or appropriate to:
(1) Comply with applicable laws, regulations, legal processes, subpoenas, court orders, or governmental requests;
(2) Enforce our terms of use, policies, contracts, or other legal agreements;
(3) Protect the rights, property, safety, or security of WildCare, our staff, volunteers, donors, program participants, or the public;
(4) Detect, prevent, or investigate fraud, security incidents, or illegal activities; or
(5) Respond to emergencies involving threats to the health or safety of any person or wildlife.
f. Business Transfers. In the event of a merger, acquisition, reorganization, dissolution, or sale of all or a portion of WildCare’s assets, personal information may be transferred to the successor organization, subject to the terms of this Privacy Policy and applicable law governing nonprofit asset transfers.
g. With Your Consent. We may share personal information with third parties when you have provided your consent or directed us to do so.
h. Aggregate and De-Identified Information. We may share aggregate, anonymized, or de-identified information that does not identify you personally with third parties for research, analysis, benchmarking, or other purposes.
6. California Consumer Privacy Rights
If you are a California resident, you have specific rights regarding your personal information under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA”).
a. Right to Know. You have the right to request that WildCare disclose the following information covering the 12 months preceding your request:
(1) The categories of personal information we collected about you;
(2) The categories of sources from which the personal information was collected;
(3) The business or commercial purpose for collecting, selling, or sharing personal information;
(4) The categories of third parties to whom we disclose personal information;
(5) The specific pieces of personal information we collected about you; and
(6) If we sold or shared your personal information, the categories of personal information sold or shared to each category of recipient.
b. Right to Delete. You have the right to request that WildCare delete personal information we collected from you, subject to certain exceptions. Upon receiving a verified request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may retain personal information if reasonably necessary to:
(1) Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall, provide a service you requested, or reasonably anticipate providing within the context of our ongoing relationship;
(2) Detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible;
(3) Debug to identify and repair errors that impair existing intended functionality;
(4) Exercise free speech rights or ensure another consumer’s right to exercise free speech;
(5) Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);
(6) Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to applicable ethics and privacy laws, when deletion would likely render impossible or seriously impair the research, if you provided informed consent;
(7) Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
(8) Comply with a legal obligation, including federal and state tax and charitable solicitation reporting requirements; or
(9) Otherwise use your personal information internally in a lawful manner that is compatible with the context in which you provided it.
c. Right to Correct. You have the right to request that WildCare correct inaccurate personal information we maintain about you. Upon receiving a verified request, we will use commercially reasonable efforts to correct the inaccurate personal information.
d. Right to Opt-Out of Sale or Sharing. You have the right to opt out of the “sale” or “sharing” of your personal information. Under the CCPA, “sale” means disclosing personal information to a third party for monetary or other valuable consideration, and “sharing” means disclosing personal information to a third party for cross-context behavioral advertising. WildCare does not sell personal information for monetary consideration. To the extent that our participation in nonprofit data cooperatives or use of analytics or advertising technologies may constitute “sharing” under the CCPA, you have the right to opt out as described in subsection h.(2) below.
e. Right to Limit Use of Sensitive Personal Information. You have the right to limit WildCare’s use and disclosure of sensitive personal information to purposes permitted under CCPA regulations, such as performing services you requested or ensuring security. WildCare does not use or disclose sensitive personal information for purposes other than those permitted by the CCPA, and therefore this right does not currently apply.
f. Right to Non-Discrimination. You have the right not to receive discriminatory treatment for exercising any of your CCPA rights. WildCare will not:
(1) Deny services to you;
(2) Charge different prices or rates for services, including through the use of discounts or other benefits or imposing penalties;
(3) Provide a different level or quality of services to you; or
(4) Suggest that you will receive a different price, rate, level, or quality of services.
g. Authorized Agent. You may designate an authorized agent to submit requests on your behalf. To designate an authorized agent, you must provide the authorized agent with written permission to act on your behalf, and we may require you to verify your identity directly with us and confirm that you provided the authorized agent permission to submit the request.
h. How to Exercise Your CCPA Rights. To exercise your rights under the CCPA, you may:

privacy@discoverwildcare.org with “Opt-Out Request” in the subject line and provide your name, email address, and mailing address;

d. Send a written request to the mailing address in subsection h.(1)(3) above.
i. Verification of Identity. To protect your privacy and security, we will verify your identity before responding to your request. Verification requirements may include:
(1) Providing your name, email address, mailing address, and telephone number;
(2) Confirming details of your prior interactions with WildCare, such as donation history, volunteer participation, or program registration; and
(3) Providing additional information or documentation if necessary to verify your identity for requests involving sensitive information.
j. Response Timing. We will respond to verified requests within 45 days of receipt. If we require additional time (up to an additional 45 days), we will notify you of the reason and extension period.
k. No Fee for Requests. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will notify you of the reason and provide a cost estimate before completing your request.
7. California Shine the Light Law
California Civil Code § 1798.83 (the “Shine the Light” law) permits California residents to request information regarding the disclosure of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year. WildCare does not disclose personal information to third parties for their direct marketing purposes. If you are a California resident and have questions about this policy, you may contact us at the address provided in Section 12.
8. Cookies and Tracking Technologies
a. Use of Cookies. WildCare’s website uses cookies and similar tracking technologies to enhance your experience, analyze website usage, and improve our Services. “Cookies” are small text files stored on your device when you visit a website.
b. Types of Cookies We Use. We use the following categories of cookies:
(1) Strictly Necessary Cookies, which are essential for the website to function properly and enable core functionality such as security, network management, and accessibility;
(2) Analytics and Performance Cookies, which collect information about how visitors use our website, such as which pages are visited most often, to help us improve website performance;
(3) Functionality Cookies, which allow our website to remember choices you make (such as your language preferences) and provide enhanced features; and
(4) Advertising and Tracking Cookies, which may be used to deliver relevant advertisements and track the effectiveness of our advertising campaigns.
c. Third-Party Cookies and Analytics. We use third-party analytics services, including [Google Analytics, Facebook Pixel, and other analytics providers], to collect and analyze information about website usage. These third-party services may use cookies and similar technologies to collect information about your online activities over time and across different websites.
d. Your Cookie Choices. You may control or disable cookies through your browser settings. Most web browsers allow you to refuse cookies or alert you when cookies are being sent. Please note that if you disable cookies, some features of our website may not function properly. You may also opt out of certain third-party analytics services:
e. Do Not Track Signals. Some web browsers have a “Do Not Track” feature that signals to websites that you do not want your online activities tracked. Our website does not currently respond to “Do Not Track” signals. However, you may opt out of tracking through the methods described above.
f. Global Privacy Control. WildCare recognizes Global Privacy Control (GPC) signals as a valid method to opt out of the sale or sharing of personal information under the CCPA. If you enable GPC on your browser or device, we will treat it as a request to opt out.
9. Third-Party Links and Services
a. Third-Party Websites and Services. Our website may contain links to third-party websites, donation platforms, social media platforms, and other online services that are not owned or controlled by WildCare, including:
(1) Online donation processing platforms;
(2) Donor account portals operated by third-party service providers;
(3) Social media platforms such as Facebook, Instagram, Twitter, and YouTube;
(4) Event registration and ticketing platforms;
(5) Email subscription management services; and
(6) Other websites and services related to wildlife, conservation, and nonprofit activities.
b. Third-Party Privacy Practices. These third-party websites and services have their own privacy policies and terms of use, which govern the collection, use, and disclosure of information you provide to them. WildCare is not responsible for the privacy practices, content, or security of third-party websites or services. We encourage you to review the privacy policies of any third-party websites or services before providing personal information.
c. Social Media Features. Our website may include social media features, such as the Facebook “Like” button, Twitter “Tweet” button, Instagram feed, and other widgets or interactive tools. These features may collect information about your IP address, the pages you visit on our website, and may set cookies to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the company providing the feature.
10. Data Security and Retention
a. Security Measures. WildCare employs reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration, or destruction. These measures include:
(1) Encryption of personal information during transmission using secure socket layer (SSL) technology;
(2) Secure storage of personal information on servers protected by firewalls and access controls;
(3) Restriction of access to personal information to employees, volunteers, and service providers who need access to perform their job functions;
(4) Regular review and updating of security practices and technologies;
(5) Training of staff and volunteers on data privacy and security obligations; and
(6) Contractual requirements that service providers implement appropriate security measures.
b. Limitations on Security. While we take reasonable measures to protect personal information, no method of transmission over the Internet or electronic storage is completely secure. WildCare cannot guarantee absolute security of personal information and is not responsible for unauthorized access, disclosure, alteration, or destruction of information resulting from circumstances beyond our reasonable control, including acts of third parties, natural disasters, or other force majeure events.
c. Data Breach Response. In the event of a data breach that compromises the security of personal information, WildCare will take prompt action to investigate the breach, mitigate harm, notify affected individuals as required by applicable law, and implement measures to prevent future breaches.
d. Retention Periods. WildCare retains personal information only as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, maintain accurate organizational records, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and the purpose for which it was collected:
(1) Donor Information: Retained for the duration of the donor relationship and for at least seven years thereafter to comply with federal and state tax reporting requirements, charitable solicitation laws, and IRS recordkeeping requirements;
(2) Volunteer Information: Retained for the duration of the volunteer relationship and for at least three years thereafter for liability, insurance, and organizational record purposes;
(3) Wildlife Assistance Records: Retained in accordance with state and federal wildlife rehabilitation permit requirements and for historical and educational purposes;
(4) Employment Records: Retained in accordance with applicable federal and state employment and tax laws;
(5) Website Usage Data: Typically retained for no more than 24 to 36 months unless longer retention is necessary for legal compliance or legitimate business purposes; and
(6) Communications and Correspondence: Retained for as long as necessary to respond to inquiries, fulfill requests, and maintain organizational records.
e. Secure Disposal. When personal information is no longer needed, WildCare securely disposes of it by deleting electronic records, shredding paper records, and directing service providers to delete information in accordance with our retention and disposal policies.
11. Children’s Privacy
a. COPPA Compliance. WildCare’s website and Services are intended for a general audience and are not directed to children under the age of 13. WildCare does not knowingly collect personal information from children under 13 through our website without verifiable parental consent, as required by the Children’s Online Privacy Protection Act (“COPPA”).
b. Educational Programs for Children. WildCare offers educational programs, classes, and events that may involve children under 13. When children participate in these programs, we collect personal information from parents or legal guardians, not directly from children, including:
(1) Parent or guardian name, address, telephone number, and email address;
(2) Child’s first name and age (for program registration and safety purposes);
(3) Emergency contact information; and
(4) Any medical or allergy information relevant to the child’s safe participation in the program.
c. Parental Rights. Parents or legal guardians may review personal information we have collected about their child, request that we delete such information, and refuse to permit further collection or use of their child’s information. To exercise these rights, contact us using the information in Section 12.

13. Your Communication Preferences
a. Email Communications. You may opt out of receiving promotional or fundraising emails from WildCare at any time by:
(1) Clicking the “unsubscribe” link included at the bottom of every marketing email we send;
(3) Contacting us using the information in Section 12.
b. Text Message Communications. If you have opted in to receive text messages from WildCare, you may opt out at any time by:
(1) Replying “STOP” or “UNSUBSCRIBE” to any text message you receive from us;
(3) Contacting us using the information in Section 12.
c. Text Messaging Terms. By opting in to receive text messages from WildCare, you agree to the following terms:
(1) You consent to receive donation-related, program, event, and other informational text messages from WildCare at the mobile telephone number you provided;
(2) Message frequency may vary depending on your engagement with WildCare;
(3) Message and data rates charged by your mobile carrier may apply;
(5) WildCare will not sell, rent, release, or trade your text messaging opt-in data or consent to third parties for their marketing or promotional purposes; and
(6) Carriers are not liable for delayed or undelivered messages.
d. Transactional and Service Communications. Please note that even if you opt out of promotional communications, we may still send you transactional or service-related communications, such as donation receipts, event confirmations, volunteer scheduling information, wildlife assistance follow-up, and administrative messages.
e. Direct Mail. If you prefer not to receive fundraising appeals or other communications by postal mail, please contact us using the information in Section 12 and provide your name and mailing address. Please allow sufficient time for us to process your request.
f. Data Cooperative Opt-Out. To opt out of WildCare’s participation in nonprofit data cooperatives and audience modeling programs as described in Section 5.c., contact us using the information in Section 12 or submit an opt-out request as described in Section 6.h.(2) above.
14. Access and Correction Rights
a. Access to Your Information. You have the right to request access to the personal information WildCare maintains about you. Upon receipt of a verified request, we will provide you with:
(1) The categories of personal information we have collected about you;
(2) The specific pieces of personal information we have collected (subject to applicable legal exceptions); and
(3) Information about how we use and share your personal information, as described in this Privacy Policy.
b. Correction of Inaccurate Information. You have the right to request that we correct inaccurate personal information we maintain about you. Upon receipt of a verified request, we will use commercially reasonable efforts to correct the inaccurate information. You may also update your contact information, communication preferences, and donor account information by:
(1) Logging into your secure donor portal (if you have created a donor account);
(3) Submitting a written request to the address in Section 12.
c. Verification. To protect your privacy and security, we will verify your identity before providing access to or correcting personal information. Verification methods are described in Section 6.i.
15. International Users and Data Transfers
a. U.S.-Based Operations. WildCare is a California-based nonprofit organization. Our website, services, and data processing operations are located in and governed by the laws of the United States and the State of California. Personal information collected through our website or Services is stored on servers located in the United States.
b. Notice to Non-U.S. Users. If you are located outside the United States and choose to provide personal information to us, please be aware that we transfer, process, and store your information in the United States. The data protection laws of the United States may differ from those of your country of residence. By using our Services or providing personal information to us, you consent to the transfer, processing, and storage of your information in the United States.
c. No International Operations. WildCare does not operate facilities or programs outside the United States and does not specifically target or solicit users outside the United States. This Privacy Policy is governed by California and U.S. federal law.
16. California Residents Under Age 18
California Business and Professions Code § 22581 permits California residents under age 18 who are registered users of online sites, services, or applications to request and obtain removal of content or information they have publicly posted. If you are a California resident under age 18 and wish to request removal of publicly posted content, please contact us at privacy@discoverwildcare.org with “California Minor Content Removal Request” in the subject line and provide a description of the content and where it was posted. Please note that such requests do not ensure complete or comprehensive removal of content, as content may be retained in backup systems, remain visible if reposted by others, or be required to be retained by law.
17. Donor Privacy and Nonprofit-Specific Practices
a. Commitment to Donor Privacy. WildCare is committed to maintaining the trust and confidence of our donors. We respect donor privacy and handle donor information in accordance with ethical fundraising standards and applicable laws, including the Association of Fundraising Professionals (AFP) Donor Bill of Rights.
b. Donor Bill of Rights Acknowledgment. WildCare acknowledges and supports the principles set forth in the AFP Donor Bill of Rights, which include donors’ rights to:
(1) Be informed of WildCare’s mission and how donated resources will be used;
(2) Be informed of the identity of WildCare’s board members and expect the board to exercise prudent judgment in its stewardship responsibilities;
(3) Have access to WildCare’s most recent financial statements;
(4) Be assured that gifts will be used for the purposes for which they were given;
(5) Receive appropriate acknowledgment and recognition;
(6) Be assured that information about donations is handled with respect and confidentiality to the extent provided by law;
(7) Expect that all relationships with individuals representing WildCare will be professional in nature;
(8) Be informed whether those seeking donations are volunteers, employees, or hired solicitors;
(9) Have the opportunity to have their names deleted from mailing lists that WildCare may share; and
(10) Feel free to ask questions and receive prompt, truthful, and forthright answers.
c. Anonymous Donations. Donors may request that their contributions remain anonymous. WildCare will honor requests for anonymity in public recognition, donor lists, and annual reports. Please note that donor information may still be retained in our internal records for tax reporting, legal compliance, and internal stewardship purposes.
d. Restricted Gifts. If you make a donation with a specific restriction or designation (e.g., for a specific program, project, or purpose), WildCare will use your donation in accordance with your restriction, subject to applicable nonprofit law governing restricted gifts.
e. Refund Policy. Donation refund requests are handled on a case-by-case basis in accordance with WildCare’s gift acceptance and refund policies. To request a refund, contact

18. Governing Law and Dispute Resolution
a. Governing Law. This Privacy Policy and any disputes arising out of or related to this Privacy Policy or WildCare’s privacy practices shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
b. Venue and Jurisdiction. Any legal action or proceeding arising out of or related to this Privacy Policy shall be brought exclusively in the state or federal courts located in Marin County, California, and you consent to the personal jurisdiction of such courts.
c. Severability. If any provision of this Privacy Policy is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
This Privacy Policy, together with any additional terms and policies referenced herein or posted on our website, constitutes the entire agreement between you and WildCare regarding the collection, use, and disclosure of your personal information through our website and Services, and supersedes any prior or contemporaneous understandings or agreements, whether written or oral, regarding such subject matter.
